Terms of Service for ImageIQ

1. Agreement to Terms

By using ImageIQ, you agree to these Terms of Service.

If you do not agree, do not use the app.

2. Service Description

ImageIQ is an iOS app for AI-powered image generation, editing, and upscaling.

The app includes:

• Project-based image workflows
• Cloud-backed project and edit storage
• Credit-based AI operations
• Subscription and one-time purchase products

3. Eligibility

You must be at least 13 years old to use ImageIQ.

4. Accounts and Security

You may use:

• Email/password authentication
• Sign in with Apple

You are responsible for account activity and credential security.

5. AI Processing and Permission

To run AI features, ImageIQ may send your data to third-party AI processors:

• Google Gemini for generation and editing
• Stability AI for upscaling

Before AI data is shared, the app asks for your permission. If you decline, AI features are unavailable.

ImageIQ does not perform facial recognition or create biometric face templates. If your selected image contains a face, that image is processed only to provide the AI feature you requested.

6. Subscriptions, Credits, and Billing

• Payments are processed through Apple In-App Purchase
• Subscriptions auto-renew unless canceled in Apple settings
• AI operations consume credits based on operation and model
• Refunds are handled by Apple under Apple policies

7. User Content

You keep ownership of your content. You grant ImageIQ a limited license to store, process, and transmit your content only to provide app functionality.

8. Acceptable Use

You may not use ImageIQ for illegal or abusive activity, including:

• Content that violates law or third-party rights
• Fraud, abuse, scraping, or service interference
• Attempts to bypass limits, billing, or security controls

9. Third-Party Services

ImageIQ uses third-party processors including:

• Convex (backend and storage)
• Supabase (authentication)
• Google Gemini and Stability AI (AI processing)
• RevenueCat and Apple (billing)
• Firebase Crashlytics (diagnostics)
• PostHog (essential AI telemetry for billing/abuse protection, plus optional product analytics)

Your use of those services is also subject to their own terms and privacy policies.

11. Disclaimers and Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE".

To the maximum extent allowed by law, we are not liable for indirect or consequential damages. Total liability is limited to amounts paid in the prior 12 months or $100, whichever is lower.
